VISITOR AGREEMENT

Welcome to the Congressional District Health Dashboard website. The Congressional District Health Dashboard (“CDHD”) is a program of NYU Langone Health and the Robert Wood Johnson Foundation (RWJF) administered by NYU Grossman School of Medicine (NYUGSoM). The purpose of this website is to publicly provide health measures at the congressional district level and other relevant geographies. This localized data allows individuals to assess the challenges their districts face, and therefore provides them with a clearer picture of how to address these challenges. By accessing or using this website you confirm that you have read, understood and agreed to be legally bound by this Visitor Agreement (“Agreement”).

The Web and this website are evolving mediums. NYUGSoM and CDHD have the right to periodically change the terms of this Agreement without notice. By continuing to use this website after changes have been posted, you agree to be bound by this Agreement, as modified. NYUGSoM and CDHD have the right to change, restrict access to, suspend, or discontinue this website, or any portion of this website, at any time.

If you are accessing this website or providing any Personal Data from within the European Economic Area, the EU General Data Privacy Regulation (GDPR) may apply to your Personal Data; please click here for additional GDPR-specific information and terms of use.

User’s Rights and Obligations

NYUGSoM and CDHD grant you, the User, a revocable, non-exclusive, non-transferable, non-sublicensable limited license to access and use the publicly available portions of this website without a password or logon for your own personal research use, subject to this Agreement. In order to use this website, you must provide and maintain adequate communications and computer equipment and obtain access to the World Wide Web directly or through devices that access web-based content. You are responsible for paying any and all service fees associated with such access.

This Agreement does not permit access to any portion of the CDHD website that is not public-facing. Additionally, this personal research license does not permit any commercial use of the data found on this website nor does it permit the creation of any derivative works from or publication of the data contained therein in whole or in part. Failure to abide by the revocable, non-exclusive, non-transferable, non-sublicensable limited license to use this website may result in the User’s restricted access to the website and/or appropriate legal action taken against the User.

FEEDBACK

We encourage you to contact us in regard to any questions, comments, suggestions, or other feedback you have about the website. You may send feedback to CDHD via the emails provided on the website. You acknowledge and agree that any feedback provided by you to CDHD is non-confidential. By sending us your feedback, you grant NYUGSoM, CDHD, and their affiliates a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works of, distribute, publicly perform and publicly display (in whole or in part) your feedback, your name and any related copyrights, moral rights or other intellectual property rights.

Proprietary Rights in CDHD Website Content; Limited License

All content on the CDHD website, including but not limited to designs, text, graphics, pictures, video, information, applications, software, music, sound and other files, and their selection and arrangement (together, the "Content"), is the property of New York University and NYU Langone Health or its licensors with all rights reserved. You are authorized to view, play, print, and download Content found on the website for personal, informational, or noncommercial purposes only, provided that you keep all copyright or other proprietary notices intact. The website Content is protected by laws pertaining to intellectual property rights, and as such, may not be copied or otherwise used for commercial use without NYUGSoM’s and CDHD’s express prior written consent.

We respect the intellectual property rights of others. Any legal action between you and CDHD related to this Agreement and/or the CDHD website shall only be brought in a federal or state court having jurisdiction in New York City, New York. You consent, and waive all objections, to the personal jurisdiction of said federal and state courts serving New York City, New York.

DISCLAIMER OF WARRANTY/LIMITATION OF LIABILITY

SEVERABILITY

If any provision of this Agreement is determined to be invalid or unenforceable, in whole or in part, the remaining provisions shall continue in full force and effect.

TERMINATION

NYUGSoM and CDHD reserve the right to terminate the User’s use of this website at any time without notice for any reason, such as, but not limited to, the User’s violation of any part of this Agreement.
